An effort to recall Jasper County District 3 Commissioner Don Jernigan in Georgia was initiated in 2023. A recall hearing was held on June 12 at the Jasper Superior Court to determine if the recall petition against Jernigan could go forward. On June 15, the recall effort was dismissed by Superior Court Judge H. Gibbs Flanders, who stated that there was a lack of evidence that Jernigan had committed an act of malfeasance. If the recall had been approved, supporters would have needed to collect a number of signatures equal to 30 percent of registered voters in the district to get the recall on the ballot.[1][2]
Recall supporters argued that Jernigan intentionally misled the public and violated the open meetings law by conducting email communication with two other commissioners regarding policy.[1][3]
In the recall hearing on June 12, Jernigan's attorney argued that the commissioner did not engage in conduct constituting malfeasance and that Jernigan did not violate open meetings law because his digital communications in question were one on one.[3]
If approved by the Jasper Superior Court, the recall petition would have had to have been signed by at least 30 percent of the number of registered voters in the district for the recall to be placed on the ballot.[1]
