Butte County is one of eight counties located within the Fourth Judicial Circuit in South Dakota. The people of Butte County are served by a circuit court and a magistrate court.

The United States District Court for the District of South Dakota has jurisdiction in Butte County. Appeals from the federal district court are heard by the United States Court of Appeals for the 8th Circuit.[1]

If more than two candidates are running for a circuit court seat, they compete in the primary election. The two candidates who receive the most votes advance to the general election.[1]
