Legislative question on ballot in New Mexico

SANTA FE, New Mexico: In New Mexico, voters will decide if former legislators can have another shot at helping out the state in another way. Come November 2, 2010, voters will decide whether or not to allow the appointment of former legislative members to civil offices. Legislative members would be appointed to those offices only under a "limited situation." Members must resign from legislature before holding any such office

If enacted by a simple majority of New Mexico voters, the measure would amend Article 4, Section 28 of the New Mexico Constitution. According to Article XIX of the New Mexico Constitution, it takes a majority vote of all members of both houses of the New Mexico State Legislature to refer a proposed amendment to the ballot. New Mexico is one of ten states that allows a referred amendment to go on the ballot after a majority vote in one session of the state's legislature.
