Missouri House of Representatives

Elections for the office of Missouri House of Representatives were held in Missouri on November 2, 2010. The signature filing deadline for candidates wishing to run in these elections was March 30, 2010 and the primary Election Day was on August 3, 2010.

Representatives are limited by term limits to a maximum of four two-year terms.

The Missouri House of Representatives has been a term-limited state house since Missouri voters approved Amendment 12 in 1992. Amendment 12 created Section 8 of Article III of the Missouri Constitution, limiting members of the state house to 4 2-year terms. As with five other states, this is a lifetime limit. (Section 8 was later amended by Amendment 3 in 2002 so that it does not apply to partial terms.)

There are 52 state representatives terming out in 2010, or 32% of the 163 members of the chamber.

In addition to the 52 Missouri state representatives who are leaving office because of term limits, l0 Missouri state senators are also termed-out.

40 incumbents (40%) face no competition in the November 2 general election and are thus, barring unforeseen circumstances, guaranteed re-election in November.

  • 18 Democratic incumbents face no November challenger.
  • 22 GOP incumbents face no November challenger.

Primary challenges[edit]

Only 13 incumbents (13%) faced competition in the August 3 primary. Three incumbents -- Democrats Hope Whitehead and James Morris, and Republican Nita Jane Ayres lost to their challengers -- Karla May, Penny Hubbard and Don Phillips respectively. The following ten incumbents (4 Democrats, 6 Republicans) won their primaries:

Retiring incumbents[edit]

11 incumbent representatives were eligible but not run for re-election, while 100 of the eligible incumbents (90%) ran for re-election. The remaining 52 incumbents termed out in 2010. Of the 11 incumbents who did not run for re-election, 5 are Democrats and 6 are Republicans.

Qualifications[edit]

To be eligible to serve in the Missouri House of Representatives, a candidate must be:[3]

  • At least 24 years of age
  • Qualified Missouri voter for two years before election
  • Resident of the district which he is chosen to represent for 1 year before election
  • Is not delinquent in the payment of any state income taxes, personal property taxes, real property taxes on the place of residence as stated in the declaration of candidacy
  • is not a past or present corporate officer of any fee office that owes any taxes to the state.
  • Has not been found guilty of or pled guilty to a felony or misdemeanor under the federal laws of the United States of America.
  • Has not been convicted of or found guilty of or pled guilty to a felony under the laws of Missouri.
  • In addition to any other penalties provided by law, no person may file for any office in a subsequent election until he or the treasurer of his existing candidate committee has filed all required campaign disclosure reports for all prior elections.
