The Washington Jury Trials for Lawsuits Without Attorneys Measure, Initiative 1390 was not on the November 3, 2015 ballot in the state of Washington as an Initiative to the People. If approved by voters, the measure would have done the following:[1]

  • Required a jury trial to be held if a lawsuit brought pro se (without an attorney) is dismissed
  • Required judicial officers to be reported to the state bar association and commission on judicial conduct if the jury returns a verdict in favor of the litigant
  • Mandated discipline by the appropriate agency and public disclosure of the discipline

Initiative Measure No. 1390 concerns pro se litigation.

This measure would require that a jury trial be held if a lawsuit that is brought pro se (without an attorney) is dismissed or sanctioned by a court pursuant to its administrative rules.

The ballot summary was as follows:[1]

This measure would require a jury trial to be held if a lawsuit brought pro se (without an attorney) is dismissed or sanctioned pursuant to the court’s rules of administration. If the jury returns a verdict in favor of the pro se litigant, the judicial officer involved must be reported to the Washington State Bar Association and the Commission on Judicial Conduct. Discipline by the appropriate agency would be mandatory and subject to public disclosure.[2]
