In Gordon v. New York Stock Exchange, 422 U.S. 659, 682 (1975), the U.S. Supreme Court held that implied immunity from the antitrust laws will be found only in the face of a "plain repugnancy between the antitrust and regulatory provisions" (quoting United States v. Philadelphia Nat'l Bank, 374 U.S. 321, 350-51 (1963)).[1]
