Government By Judiciary

Government by Judiciary is a book written in 1977 by constitutional scholar Raoul Berger who argues that in adopting the Incorporation Doctrine, the Supreme Court has misconstrued the Fourteenth amendment of the United States Constitution. According to the Tenth Amendment Center, "incorporation" itself ignores the 9th and 10th amendments.^[1] Thus, by ignoring the amendments they are effectively overturned or abolished.^[2]

Much of the book focuses on the judicial malpractice that took place during the Warren Court.
